EIN for Non-Residents: Get Your LLC’s Tax ID Without an SSN

An EIN is your LLC’s federal tax ID. Banks, Stripe, Amazon and the IRS all ask for it. If you live outside the US, here is exactly how to get one without an SSN, how long each method takes, and the mistakes that cause delays.

Quick answer

EIN for non-residents, in short: yes, a non-resident can get an EIN for a US LLC without an SSN or ITIN. You file IRS Form SS-4 after the state approves your LLC. Foreign applicants cannot use the IRS online tool, so they apply by phone (the EIN is issued during the call), by fax (about a week, often longer) or by mail. With LLCPronto, you get your EIN within 24 hours: our team handles the IRS application for you. The IRS charges nothing.

What Is an EIN?

An EIN (Employer Identification Number) is a nine-digit federal tax ID that the IRS gives to a business, written like 12-3456789. It is also called a federal tax ID or FEIN. It belongs to your LLC, not to you, which is why a company owned by someone in Dubai, London, Toronto or Lagos can have one.

Do You Need an EIN for Your LLC?

In practice, yes. Almost every next step after forming a US LLC asks for it:

Can You Get an EIN Without an SSN?

Yes. US law does not require the owner of an LLC to have an SSN or ITIN to get an EIN. The only difference is how you apply: the IRS online tool is not open to you, so you use Form SS-4 by phone, fax or mail. On the form, the “responsible party” is the person who owns or controls the LLC, which for most single-owner LLCs is you.

Three Ways for International Applicants to Apply

MethodHow it worksHow long it takes
PhoneA phone application to the IRS international line with a completed Form SS-4, with long hold times and international call costsEIN issued during the call
FaxFax the signed Form SS-4 to the IRS international fax line (+1 304-707-9471 from outside the US) with a return fax numberIRS says about 4 business days; applicants often report 1 to 4 weeks
MailPost the signed Form SS-4 to the IRS international addressAbout 4 weeks, plus postal time

The phone line is the fastest, but calls can be long and the person calling must be authorised on Form SS-4 to receive the number. That is the step we handle for our clients.

What You Need Before Applying

  • Your LLC must already be approved by the state, and you need its exact legal name
  • The LLC’s address (often the registered agent or business address) and your own foreign address
  • The responsible party’s full name
  • The number of members (owners) and the start date
  • A short description of what the business does
  • A signed third-party designee section, if someone applies for you

EIN vs ITIN vs SSN

NumberWho gets itUsed for
EINBusinesses, including foreign-owned US LLCsThe LLC’s banking, payments and tax filings
ITINIndividuals who need a US tax number but cannot get an SSNPersonal US tax returns
SSNUS citizens and people authorised to work in the USPersonal identity and taxes

For most international founders, the EIN is all they need. An ITIN is only needed in specific cases, such as filing a personal US tax return.

After You Get Your EIN

  • Save the IRS confirmation. Banks, Stripe and Amazon often ask for it.
  • Use the same LLC name everywhere. It must match the state filing exactly.
  • Know which tax form to give platforms. A single-member LLC is “disregarded” for US tax, so platforms usually ask the owner for Form W-8BEN rather than the LLC’s own form.
  • Put Form 5472 in your calendar. It is due each April 15 for a foreign-owned single-member LLC.

Common EIN Mistakes

  • Applying before the state approves the LLC. The IRS needs the exact legal name.
  • A different spelling from the state filing. This causes bank and Stripe rejections later.
  • Wrong number of members. One member or more changes how the IRS classifies the LLC.
  • Applying twice. A second application can create two EINs for one company, which is hard to undo.
  • Using a nominee as the responsible party. The IRS expects the real owner or controller.
