The state keeps things simple. You pay $50 once, and the state does not ask for an annual report after that. The only yearly cost most owners have is their registered agent. For a small online business, that makes it one of the lowest-cost states to run an LLC.

How to Form a New Mexico LLC in 5 Steps

  1. Choose a name. It must include “Limited Liability Company,” “LLC,” “L.L.C.” or a similar ending and be different from other names on file with the Secretary of State.
  2. Hire a registered agent. Your agent needs a physical address in New Mexico. If you live elsewhere, use a registered agent service.
  3. File Articles of Organization. File online through the Secretary of State’s Business Filing Portal and pay the $50 fee. You list the LLC name, registered agent and organizer. Member names are not required.
  4. Write an operating agreement. It is not filed with the state, but it proves who owns the LLC. Banks and payment platforms ask for it.
  5. Get your EIN. The EIN is free from the IRS. If you don’t have an SSN, we apply for you with Form SS-4.
